1 Scope of application
The General Terms and Conditions (hereinafter referred to as "GTC") apply to all orders placed and contracts concluded (hereinafter referred to as "order") via the online shop of Potion Commotion (hereinafter referred to as "P-C"). P-C reserves the right to amend the GTC. The version of the GTC applicable at the time of the order is authoritative and cannot be unilaterally amended for this order.
2. offer
The offer is aimed at natural customers domiciled in Switzerland or legal customers domiciled in Switzerland. Deliveries are only made to addresses in Switzerland. The offer is valid as long as it is visible in the online shop and/or stocks last. Prices and product ranges are subject to change at any time. The images shown in the online shop and all information on the products are for illustrative purposes only and are non-binding.
3. price
Prices are quoted in Swiss francs, including value added tax (VAT). The price in the online shop at the time of the order is decisive.
4. order
The presentation of the products in the online shop is not a legally binding application, but a non-binding online catalogue or a non-binding invitation to customers to order the product in the online shop. An order is deemed to be an offer to P-C to conclude a contract.
After submitting the order, the customer automatically receives a confirmation of receipt, which documents that the order has been received by P-C.
P-C is free to refuse orders when facing difficulties in procuring, preparing, or delivering the product . In this case, the customer will be informed and any payments already made will be refunded. Further claims are excluded; in particular, products that cannot be delivered will not be forwarded. Products that are temporarily unavailable cannot be reserved.
5. payment options
Payments must be made in Swiss francs. Credit cards and debit cards are accepted as means of payment. The available means of payment are displayed in the online shop.
The amount will be debited immediately. Purchase on account is not possible.
6 Conclusion of contract
A contract is only concluded when the order is prepared by the Potion Commotion fullfillement . As soon as the order has been prepared for dispatch, the customer receives an order confirmation by e-mail.
7. delivery
The customer's delivery address must be in Switzerland. No deliveries are made at weekends or on official national or cantonal public holidays. If the customer is not on site at the time of delivery and has not given any special delivery instructions, the delivery person will leave a collection notice in the letterbox. The customer must then collect the delivery from the relevant post office.
Any order that is not collected within the specified deadlines cannot be retained or refunded. Customers are solely responsible for orders collected late and any rights in respect of defects are excluded.
Customers are requested to additionally confirm their collection with their signature. Any liability for damages incurred by the customer due to loss, theft, misuse, etc. in connection with the collection process or the collection slip is expressly excluded. The customer assumes responsibility for the delivered products, even if they were not received directly by the customer.
8 Delivery costs
The delivery costs communicated in the online shop apply. The delivery costs are listed as an additional item in the shopping basket and on the invoice.
9 Warranty
P-C can provide the warranty either by partial or complete replacement with an equivalent product.
10 Returns
The buyer bears the costs for returns. Returns must be agreed in advance with P-C (admin@potion-commotion.com).
11. notification of defects
If products are delivered with obvious damage to the packaging or contents, the customer must, without prejudice to his rights in respect of defects, complain to the delivery agent immediately and refuse acceptance. The customer is obliged to obtain a confirmation of damage from the delivery agent. All transport damage must also be reported immediately to P-C. Furthermore, it is the customer's responsibility to inspect the ordered products immediately upon receipt. In the event of any defects or deviations from the order, P-C customer service must be notified by e-mail admin@potion-commotion.com on the day of delivery. P-C reserves the right to demand proof of the defect.
12. transfer of risk
The risk shall pass to the Buyer as soon as the consignment has been handed over to the person carrying out the transport. If dispatch is delayed or becomes impossible through no fault of our own, the risk shall pass to the buyer upon notification of readiness for dispatch. Any assumption of transport costs by P-C agreed in individual cases has no influence on the transfer of risk.
13. limitation of liability
Claims for damages arising from impossibility of performance, from breach of contract, from culpa in contrahendo and from tort are excluded both against us and against our vicarious agents, except in cases of wilful misconduct or gross negligence. No liability is accepted for consequential damage resulting from the use of the products.
14 Applicable court and place of jurisdiction
Wallisellen is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law.
